This submission is made in terms of section 45(1)(c) of the Constitution and Joint Rule 102, which allow any person or body to make representations to the Joint Constitutional Review Committee for consideration of constitutional amendments or review of legislative inadequacies.
This submission to the Joint Constitutional Review Committee sets out urgent, comprehensive proposals for constitutional amendments to address South Africa’s unresolved colonial legacy and the systematic dismantling of Indigenous kingdoms and governance systems. After 29 years of Constitutional democracy, the foundational injustices of colonial conquest and apartheid-era dispossessions remain unaddressed. Indigenous communities continue to face tenure insecurity and marginal recognition, despite their deep historical, cultural, and political significance.
